Welcome to Fyllo. These Terms of Service ("Terms") govern your access to and use of the Fyllo website, mobile-optimized platform, and all related services (collectively, the "Service") operated by Fyllo ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

Fyllo is a location-based plant sharing platform that enables users to share, swap, and discover plants within their local communities. Our mission is to foster sustainability, connection, and a shared love of nature.

1. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete. We reserve the right to suspend or terminate accounts that violate this requirement.

2. Account Registration

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Your user profile may include a profile picture, banner image, bio, and approximate location. For your safety, your profile will only display a general area (approximately a 5-mile radius) rather than your exact home address. You may share your precise address or arrange a meeting location only after confirming a plant swap with another user.

3. User Safety

Your safety is important to us. When arranging plant swaps or meeting other users in person, we strongly recommend the following:

• Meet in a public, well-lit location for all in-person exchanges.
• Inform a friend or family member of your plans, including the time and location of the meetup.
• Do not share your exact home address until you have established trust with the other user.
• Trust your instincts — if something feels off, cancel the swap.
• Report any suspicious or inappropriate behavior to us immediately.
• Consider meeting at a local propagation station or coffee shop partner location when available.

Fyllo is not responsible for the conduct of any user, whether online or offline. You use the Service and arrange meetups at your own risk.

4. Plant Sharing & Swaps

Fyllo facilitates the sharing and swapping of plants between users. When listing a plant, you agree to provide accurate descriptions, including the plant's species, condition, and care requirements to the best of your knowledge. You are solely responsible for the accuracy of your listings.

All plant exchanges are conducted directly between users. Fyllo does not take possession of, inspect, or guarantee the quality, health, or condition of any plants exchanged through the Service. We are not a party to any transaction between users and bear no liability for disputes arising from plant swaps.

Users should be aware that certain plants may be regulated, invasive, or prohibited in specific regions. It is your responsibility to comply with all applicable local, state, and federal laws regarding the possession, propagation, and transport of plants.

5. Location-Based Services

Fyllo uses location data to help you discover plants and connect with other plant enthusiasts near you. You may provide your location through GPS, zip code, or city search. Your approximate location (5-mile radius) may be displayed on your profile and in search results to facilitate local connections.

You may adjust your location settings or disable location sharing at any time through your profile settings. However, disabling location services may limit your ability to use certain features of the Service, such as discovering nearby plants or participating in local swap events.

6. Community Guidelines

Fyllo is built on a foundation of kindness, sustainability, and mutual respect. By using the Service, you agree to:

• Treat all community members with respect and courtesy.
• Provide honest and accurate information in your listings and communications.
• Honor your commitments — if you agree to a swap, follow through or communicate promptly if plans change.
• Refrain from posting offensive, misleading, or harmful content.
• Not use the Service for commercial sales unless explicitly permitted.
• Not engage in harassment, discrimination, or any form of abusive behavior.
• Respect the intellectual property rights of others.

Violations of these guidelines may result in warnings, suspension, or permanent removal from the platform at our sole discretion.

7. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, and software — are the property of Fyllo or its licensors and are protected by copyright, trademark, and other intellectual property laws.

By posting content on Fyllo (including photos, descriptions, and community posts), you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the Service. You retain ownership of your content and may remove it at any time.

8. Wishlist & Notifications

Fyllo allows you to create wishlists of plants you are seeking. When a plant on your wishlist becomes available nearby, we may send you a notification via email or in-app alert, depending on your notification preferences. You may manage your notification settings at any time through your profile.

We do not guarantee the availability of any specific plant, and notifications are provided on a best-effort basis. Fyllo is not responsible for missed notifications or the unavailability of desired plants.

9. Badges & Gamification

Fyllo awards badges and recognition based on user activity, such as the number of successful swaps completed. Badges are for display purposes only and carry no monetary value. We reserve the right to modify, revoke, or discontinue the badge system at any time without prior notice.

10. Events & Propagation Stations

Fyllo may facilitate local plant swap events and collaborate with local businesses (such as coffee shops) to establish propagation stations. Participation in events is voluntary and subject to any additional terms or guidelines posted for specific events.

Fyllo is not responsible for any incidents, injuries, or disputes that occur at in-person events or propagation station locations. Event hosts and venue partners may have their own terms and policies that apply.

11. Privacy

Your privacy matters to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

We take reasonable measures to protect your personal information, including displaying only your approximate location on your public profile. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

Plant care tips, identification results, and other informational content provided through the Service (including AI-powered plant identification) are for general guidance only and should not be relied upon as professional botanical or horticultural advice. We make no guarantees regarding the accuracy of plant identification or care recommendations.

Fyllo does not guarantee the quality, safety, or legality of plants listed on the platform, the truth or accuracy of user listings, or the ability of users to complete a swap.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Fyllo and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to Fyllo, if any, during the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Fyllo and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

15. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. You may also delete your account at any time through your profile settings. Upon termination, your right to use the Service will immediately cease, but provisions that by their nature should survive termination (such as disclaimers, limitations of liability, and indemnification) will remain in effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
